(“the Competition”)
The following rules will apply to the Competition (“Terms & Conditions”):
- INTRODUCTION
1.1. The Competition is organised and managed by John Brown (Pty) Ltd (“the Agency”) on behalf of Fresh Living (“the Promoter”).
1.2. By entering the Competition, participants and winners agree to be bound by these Terms and Conditions which will be interpreted by the Promoter in conjunction with the Agency, whose decision regarding any dispute will be final and binding.
1.3. The Promoter reserves the right to amend, modify, change, postpone, suspend, or cancel the Competition and any prizes (which have not yet been subject to a draw), or any aspect thereof, without notice at any time, for any reason which the Promoter reasonably deems necessary.
1.4. No part of these Terms & Conditions is intended to or shall be misconstrued as unlawfully restricting and/or limiting any rights and/or obligations, as the case may be, created for either the participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (“the CPA”).
1.5. South African laws govern this competition.
1.6. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.
1.7. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
1.8. All participants to the Competition, participate entirely at their own risk. By reading and accepting these Terms & Conditions, the participant hereby indemnifies and holds harmless the Promoter, the Agency and associated entities; their directors, employees and agents from any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained directly or indirectly as a result of their participation in the promotional competition and related events and activities, or resulting from the acceptance of and/or use of the prize/s on offer , including but not limited to loss/damage arising out of/pursuant to personal injury, death, property damage and claims based on publicity rights, defamation and/or privacy rights.
2. DURATION & RULES OF THE COMPETITION
2.1. The Competition commences on 26 November 2021 and ends on 3 December 2021, both days inclusive. Entries received after the closing date will not be considered.
2.2. The Competition is open to permanent residents of South Africa over the age of 18 years only, except any employee, director, member, partner, agent or consultant or any person directly or indirectly, who controls or is controlled by the Promoter and/or the Agency, immediate family members, advisers, dealers, suppliers and/or associated companies, and/or a participant who has won a prize through a promotional competition run by the Promoter at least three months prior to the announcement of the winner of the Prize (“Disqualified Persons”).
2.3. Participants and/or the winner will be required to provide their proof of identity to verify that they are above the age of 18.
2.4. Participants understand and agree that to conduct the Competition, the Agency on behalf of the Promoter, must collect and process personal information about them. By entering this Competition, participants consent to the processing of his/her personal information. 2.5. Participants cannot be a juristic entity and must be a natural person.
2.6. Prizes are non- transferable and cannot be exchanged for cash. The prize will be couriered to the winners within three weeks of acceptance of the prize.
2.7. No entries from agents, third parties, organised groups or automatically generated entries by computer will be accepted. No incomplete or corrupted entries will be accepted. Entries will only be accepted if they comply with all entry instructions.
2.8. By entering the Competition, the winner/s agree to their names being used in any advertising and promotional material for this competition. Winners may ask that their names be removed or refuse to take part in any publicity. Participants will not receive any payment for taking part in the competition or taking part in any media format related to it.
2.9. Responsibility is not accepted for entries lost, damaged, or delayed because of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.
2.10. In terms of the CPA the Promoter is required to keep a record of all persons used to promote the Competition and as such the Agency will keep this agreement for a period of 3 (three) years in compliance with the CPA on behalf of the Promoter.
3. HOW TO ENTER
3.1. Participants stand a chance to win a hamper containing a 3-month supply of Rascallion wines, featuring the “With Love from the Cape” range: Sauvignon Blanc, Chenin Blanc, Cabernet Sauvignon, Pinotage, Pinotage Rosé to the value of R2,700. The prize contains 36 bottles of wine. Only 1 (one) winner will be selected across both Social Media Platforms.
3.2. To be eligible for the prize participants will be required to enter either by COMMENTING on the Fresh Living Facebook competition post telling us their favourite place to sip on Rascallion wine this summer – Or by COMMENTING on the Fresh Living Instagram competition post with a food emoji that pairs perfectly with the favourite Rascallion wine. Only 1 prize will be selected across both Social Media Platforms.
3.3. Winners of the prize will be determined by random draw at the end of the Competition from all the entries received during the competition term and notified by direct message via the Social Media Platform they used to enter. The decision is final, and no correspondence will be entered.
3.4. The Promoter reserves the right to disqualify a winner should they fail to respond to the direct message via the Social Media Platform/s within 48 hours of being notified and furthermore the Promoter reserves the right to randomly select a replacement winner from the entries for the Competition.
3.5. An announcement relating to the winner of the Competition will only take place once the winner has been contacted and all their details have been verified in accordance with clause 2.3.
4. SOCIAL MEDIA PLATFORMS
4.1. This Competition is in no way sponsored, endorsed, or administered by, or associated with Facebook, Instagram or any other social media platform that may be used to promote the competition. Participants acknowledge that they are providing information to the Promoter and the Agency only and not to Facebook or Instagram, or any other social media platform.
4.2. All participants in this Competition indemnify Facebook and Instagram, and all other social media platforms of all liabilities for and claims arising out of or in connection, including any damage you may suffer with this Competition and these Terms and Conditions.
